HOW TO FILE

SallyPort Watch is a non-governmental independent watchdog organization established to oversee the New Mexico Military Institute at Roswell, New Mexico.  


DISCLOSURE OF YOUR IDENTITY  

We recognize that you may want to maintain your confidentiality when filing a complaint. Below are the options available to you and the impact  on complaint processing: 


1. Anonymous Filing:  To file anonymously, do not include your name, phone, or personal email.  The email field is required due to form functionality.   However,  you may create a new anonymous email to use from various anonymous email providers or you can use "hotline@sallyportwatch.org" which will loop the information to us without the need of your personal email. 


2. Disclosure to SPW Only:    You may disclose your identity through the online form and state in the "Complaint" section that you do not consent to the disclosure of your identity to any other party outside of SPW.   


It should noted that if you opt for anonymous filing or restrict disclosure only to SPW, it may hinder the ability to fully review and investigate your allegations if accepted.    


 

WHAT TO INCLUDE IN THE COMPLAINT


Please provide a summary of your allegations, including what, when, where, who, and how.  For example: 

  • What did the subject do or fail to do that was wrong? Provide specific details
  • When did the wrongdoing occur?
  • Where did the wrongdoing occur?
  • How and when did you learn of the wrongdoing?
  • Do you have firsthand knowledge of the events?
  • Names and contact information of other individuals who are aware of the wrongdoing.
  • If supporting documentation exists outside your control, where can that documentation be found?


WHISTLEBLOWER ACT


The New Mexico Whistleblower Act prohibits public employers from retaliation against governmental employees for ——. The prohibitions on employer retaliation are set forth at NMSA § 10-16C-3.


NMSA § 10-16C-3

The New Mexico Whistleblower Act reads as follows:

“A public employer shall not take any retaliatory action against a public employee because the public employee:


    “A. communicates to the public employer or a third party information about an action or a failure to act that the public employee believes in good faith constitutes an unlawful or improper act;
   B. provides information to, or testifies before, a public body as part of an investigation, hearing or inquiry into an unlawful or improper act; or
   C. objects to or refuses to participate in an activity, policy or practice that constitutes an unlawful or improper act.”
